Expressions of Interest are invited from suitably qualified Applicants for the services described below. This procurement is subject to the World Trade Organization Agreement on Government Procurement.
 
 
1.  Background Information
 
MTR Corporation Limited invites qualified consultants to express their interest in tendering for Consultancy Agreement A322-24E Independent Safety Assessment for New Rolling Stock in DRL.
2.  Scope of Works
 
The existing trains that currently serve Disneyland Resort Line (DRL) will be replaced with 3 new 4-car trains equipped with traction-battery technology. The new trains can operate with power supplied from the existing overhead line or power supplied from trainborne batteries. The new trains are planned to be put into service in 2028.
The scope of the consultancy services includes the independent safety assessment and independent safety audits at the Contractor’s premises including manufacturing facilities, design offices, site offices in Mainland China, Hong Kong, and other countries where equipment and sub-systems are manufactured, delivered, installed, tested and commissioned including those activities carried out on site in Hong Kong. The Consultant shall also review and assess the robustness of the safety management processes including a technical review on the technical details like drawings, reports, simulation results etc. to assure the adequacy of the safety protection undertaken for the critical systems and the associated interfaces.

4.  Expressions of Interest
 
To be considered for prequalification, interested parties having relevant resources, qualifications and experience are requested to express their interest on or before 28 May 2024 via the MTR Corporation Limited’s E-Tendering System.

5.  Deadline to Return Answers / Information
 
Applicants will receive a prequalification invitation via the E-Tendering System. The Applicants shall complete and submit all required information and details via the E-Tendering System no later than the time and date specified in the prequalification invitation letter.
All invitations and submissions for prequalification will be carried out through the E-Tendering System at http://www.hkextender.com.
 
6.  Other Matters
 
Applicants responding to this advertisement are deemed to have complied with the Personal Data (Privacy) Ordinance in the collection and transfer of personal data to MTR Corporation Limited. All information submitted including personal data, will be used by MTR Corporation Limited for the prequalification of tenderers for this project.
Applicants shall note and make themselves aware of the Corporation’s ethical and probity requirements which shall be applied throughout the tender and contract periods. Further, Applicants shall not, and shall ensure that its directors, employees, agents and sub-contractors shall not, offer or give any advantage as defined in the Prevention of Bribery Ordinance (Cap. 201) to any employee or agent of MTR Corporation Limited. Any breach or non-compliance with this paragraph by the Applicant shall, without affecting its liability for such breach or non-compliance, result in its application not being considered.
Applicants shall not apply for prequalification as an entity if you intend to act as a supplier, sub-contractor or sub-consultant for another entity who will also apply for the prequalification, or if you are a partner in a joint venture established to seek prequalification for this Contract.
Companies having linkage to each other, e.g. subsidiaries, holding or sister companies, shall not apply for prequalification as a tenderer for the same contract, whether as a single entity or as a partner of a joint venture. “Sister company” shall mean all companies which are subsidiaries of or otherwise belonging to the same holding company. The existence of a holding-subsidiary relationship shall be determined in accordance with the provisions in Sections 13 to 15 of the Companies Ordinance (Cap. 622) of Hong Kong. Companies having linkage to each other shall elect which company shall apply for prequalification.
